The rule of law has been eroded and the Constitution brazenly disregarded. At the heart of this crisis is the concerning conduct of Justice Luke Malaba, the Chief Justice of the Constitutional Court, who has emerged as a tool of the ruling Zanu PF party, selectively applying the law to punish opposition leaders and civic society activists.
It all started with events surrounding the controversial extension of Justice Malaba’s tenure, despite the clear constitutional provisions that should have limited his time in office, have cast a dark shadow over the independence and integrity of the Zimbabwean judiciary. Through a series of questionable legal maneuvers, the Zanu PF government sought to retain Malaba’s influence, undermining the very foundations of the country’s judicial system.
The selective application of the law has been particularly evident in the handling of cases involving opposition figures and civic society leaders. While the government’s allies have enjoyed a degree of impunity, those who dare to challenge the status quo have been subjected to a relentless campaign of persecution, with trumped-up charges and questionable rulings that undermine their fundamental rights and freedoms. This corrosion of the judicial system has dire implications for the future of Zimbabwe. Without a robust and independent judiciary, the country’s fragile democracy is under constant threat, and the aspirations of the Zimbabwean people for a just and equitable society remain elusive.
It is high time for the Zanu PF government to heed the calls of the international community and the people of Zimbabwe to restore the integrity of the judicial sector. The systematic undermining of the Constitution and the selective application of the law must be addressed with urgency, ensuring that the courts once again serve as the bulwark of justice and the safeguard of the people’s rights.The future of Zimbabwe depends on the restoration of the rule of law and the independence of the judiciary, free from the corrosive influence of political interference.
