The CCC’s top lawyer, Advocate Thabani Mpofu, took the time to explain today’s court hearing. The hearing aimed to address the issue of the illegal recalls of CCC MPs and Senators by an imposter Secretary General last month.

In a blog post, Mpofu refuted news suggesting that lawyers representing CCC officials had totally withdrawn their case against the Speaker and President of the Senate.

Mpofu stated, ‘The purveyors of falsehoods are at it again, so there is a need for light to shine.’

He went on to provide more details, revealing that it was not true that the lawyers withdrew their position that the Speaker of Parliament’s actions were illegal.

‘It is not correct that the lawyers, led by the able and effective Adv Amanda Ndlovu and the perpetually truthful Alec Muchadehama, withdrew the application against the Speaker.’

In the subsequent explanation, he clarified that the lawyers maintained their stance that Mudenda’s actions were illegal, and this position still holds.

‘The correct position is that a declaratur bearing on the illegality of Mudenda’s actions has been maintained and is still being sought.’

He concluded by specifying what was withdrawn by the lawyers, citing paragraph 5 of the conditions or demands set by the applicants, in this case, the recalled MPs, which reads, ‘Respondents and all those claiming or acting through them or on their behalf are hereby interdicted from interfering with Applicants’ duties as Members of Parliament.’

‘What was withdrawn is the interdictory relief sought in paragraph 5 attached.’ Mpofu said

Mpofu reiterated that Mudenda’s conduct was illegal and remains challenged in the courts of law.

‘Applicants maintain that Mudenda conducted himself illegally.’
